Terms of Service

These terms apply to your use of this website and to any work Crest Painting & Decorating (ABN 96 849 032 407) carries out for you, unless a signed contract for a specific job says otherwise — in which case that contract governs.

Online estimates are indicative only and are not offers. A quote is binding on us only when issued in writing after an on-site measure, and only for the scope it describes.

Quotes are open for acceptance until the expiry date shown on them. A quote is accepted when you confirm it in writing. Prices are in Australian dollars; where a quote is stated exclusive of GST, GST is added at the prevailing rate.

We will do the work described in the accepted quote. Anything not described is not included.

If, once work starts, we find conditions that could not reasonably have been identified at the measure — undisclosed damage, failed substrate, previous coatings requiring removal, rot, rust, mould behind fixtures, lead or asbestos-containing material — we will stop, tell you, and give you a written variation before continuing. You are not committed to a variation until you approve it in writing.

So we can work safely and on programme, you agree to give us reasonable access to the property on the agreed dates, provide power and water, remove or secure valuables and fragile items, keep pets and children clear of work areas, and tell us in advance about anything that affects safety — including asbestos, lead paint, unstable structures and hazardous animals.

Where access is not available on an agreed date and we have mobilised, we may charge reasonable standing costs.

You are responsible for final colour selection. Colours must be confirmed against a physical sample applied to the actual surface before work begins — not from a screen. Repainting because of a change of mind is a variation and is charged.

Payment terms are stated on the quote and invoice. Unless the quote says otherwise, progress claims apply to larger jobs and the balance is payable on practical completion. We may suspend work on overdue accounts, and recovery costs on unpaid accounts are payable by you.

You may cancel before work starts; where we have already incurred cost — bespoke tinted product, scaffold hire, cancelled crew bookings — that cost is payable. Where these terms are a contract to which the cooling-off provisions of the Australian Consumer Law or state home-building legislation apply, those rights apply and are not affected by this clause.

On completion we will walk the work with you. Raise anything you are not satisfied with then, or in writing within seven days, and we will rectify defective workmanship at our cost. Workmanship is separately covered by our workmanship warranty.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees.

To the extent permitted by law, our liability for breach of a non-excludable guarantee is limited to resupplying the services or paying the cost of having them resupplied, and we are not liable for indirect or consequential loss, including loss of rent, profit or opportunity.

Content on this site belongs to us or our licensors. You may view and print it for your own purposes. You may not scrape, republish or use it commercially without permission, attempt to gain unauthorised access to any part of the system, or submit content you do not have the right to submit.

These terms are governed by the laws of Western Australia, and the courts of Western Australia have jurisdiction.
